We are experiencing technical difficulties with the software we use for scanning powers of attorney and other procedural documentation. This means that documentation received from 5th October is waiting to be scanned. If there is a need for us to expedite the registration of a power of attorney sent in the past week please your request e-mail POA-INV@scotcourts.gov.uk to let us know.

In January 2025 we explained that two advisory emails would be sent to the sender when a PoA failed to meet the registration criteria. We are pleased to advise that normal service will resume from 31st March 2025 whereby senders will receive a single explanatory email when a PoA, submitted via EPOAR, cannot be registered. Earlier this year we added a new check to our registration process to ensure that we have due jurisdiction to deal with a power of attorney (PoA) submitted for registration. Please note that from 2 June 2020 the EPOAR facility will be updated to include four statements below: The granter lives in Scotland The granter has property in Scotland (e.g. a house, bank account etc.) The granter does not normally live in Scotland and it is a matter of urgency to submit the PoA for registration

The new online digital service allowing attorneys to provide an access code to organisations confirming their status as attorney and the powers granted to them is only available for powers of attorney made under English legislation. This service is not available for the purposes of continuing and welfare powers of attorney made under Scottish legislation i.e. the Adults with Incapacity (Scotland) Act 2000

We appreciate that in some cases there is a genuine need for a power of attorney (PoA) to be processed urgently due to the granter’s circumstances. We offer an expedited registration service in recognition of this. To request this service we need key information from you and the reason why the PoA is to be given priority over other PoAs. Please complete our form if you wish to request, . There is no need to contact us to ask for the status of the PoA, this may inadvertently delay the PoA
